LASTING POWERS OF ATTORNEY
Appointing a Power of Attorney is crucial for ensuring your affairs are managed according to your wishes in case of incapacity. Our experts offer support in appointing the right individuals to act on your behalf. Lasting Power of Attorney (LPA) is needed so you can legally appoint one or more people you trust to make decisions on your behalf if you lose the mental capacity to do so yourself. A financial decisions LPA lets those named handle (and make decisions about) your money and property. This can include paying your bills, selling your property, collecting your pension and collecting your benefits. Types of lasting Powers of Attorney
Property and Financial Affairs LPA
There are two types of LPA, and you may choose to set up one or both:
This allows your attorney to make decisions about your finances and property including: Managing bank or building society accounts, paying bills and managing debts, Collecting benefits or pensions, Buying or selling your home. This type of LPA can be used as soon as it registered, with your permission, while you still have capacity
Health and Welfare LPA
This authorises decisions about your:
.Medical care and treatment
.Moving into a care home
.Life-sustaining treatment
This LPA can only be used if you have lost mental capacity.
Register the LPA
Before an LPA can be used, it must be registered with the office of the Public Guardian(OPG). Registration typically takes 8 to 10 weeks if completed correctly. The current fee to register each LPA is £92, with reductions/exemptions available. Cancelling or Changing an LPA if you still have mental capacity, you can cancel an LPA at anytime by sending a deed of revocation and the original document to the OPG. Changes of personal details(such as address) must be reported to OPG.
How to make an LPA?
Setting up a LPA involves the following steps:
1. Choose Your Attorney(s)
you may appoint one or multiple attorneys. They must be over 18 and someone you trust to act in your best interests.
2. Complete the LPA Forms, forms can be completed online at GOV.UK, by downloading paper forms(LP1F for financial affairs, LP1H for health and welfare). You must have mental capacity and must not be placed under pressure to sign the document. A certificate provider confirms this.
Who Oversees LPAs?
The office of the Public Guardian (OPG) is the UK government agency responsible for:
.Registering LPAs
.Maintaining the official LPA register
.Investigating concerns about attorneys
.Supporting donors, attorneys, and families.
It is an executive agency of the Ministry of Justice and operates under the Mental Capacity Act 2005.
When should you consider an LPA?
Legal and care charities recommend putting an LPA in place sooner rather than later-well before you might need it. Unexpected illness or accidents can occur at any age, and an LPA arranged early brings peace of mind and makes life simpler for those you care about.
